Chapter 4

 

Duty, function and authority of Central Executive Committee officials

26. Chairman:
  a. To provide an effective leadership in running the party as a strong and efficient organization by holding high the ideals, principles and prestige of the party.
  b. To chair party general convention, central council and central committee meetings; to assign responsibilities, to provide directives through various levels of the party committees.
  c. To maintain party discipline and direct the central executive committee whenever necessary for action.
     
27. Vice-Chairman:
  a. To carryout the responsibilities of the chairman in his absence.
  b. To carryout any other functions as required by the party.
     
28. General Secretary:
  a. To conduct day to day function of the party, call party meetings as instructed by party chairman and to carryout the functions as stipulated by the chairman from the time to time.
  b. It will be the responsibility of the party general secretary to implement party decisions.
  c. To submit party report in the general convention, central council and committee meetings.
  d. It will be the responsibility of the party general secretary to ensure day to day running of the party central office.
  e. It is the responsibility of general secretary to have all the party documents and records maintained.
     
29. Treasurer:
  a. The responsibility of all the party funds lies with the treasure.
  b. To have income and expenses audited by an auditor and submit this report to the party convention, council and committee as per the instruction of the chairman.
  c. Have the entire executive and other committees maintain their financial accounts audited and updated.
  d. To collect contribution from party members as fixed by the central committee from party members who are elected, nominated or appointed with party approval.
     
30. Party Spokesperson:
  It is the function of the party spokesperson to make public, the official view of the party on various current issues and policies, through the media.
     
31. Assistant general secretary:
  a. To carryout all the responsibilities of general secretary in his absence.
  b. To carryout other directions of general secretary.
  c. To look after and control party central office management.
  d. To do party appointed tasks.
     
32. Parliamentary Board :
  a. Either the party chairman or one of the central members appointed by the chairman will chair this board. This board will constitute the following formation
    i. Party chairman or one of the central members appointed by the chairman Chairman
    ii. Parliamentary leader Member
    iii. Five nominated members of the central council by the chairman Members
    iv. One of the committee members appointed by the Chairman Member-Sec.
    v. In case when one person is both the party chairman and parliamentary leader, then 6 instead of 5 will be nominated members.
  b. Functions, Duties and authority of this board will be as follows:
    i. To give necessary directions to the party members elected in the parliament and coordinate with the parliament in regards to party activities.
    ii. To select candidates for general election on the recommendation of regional executive committee and forward the report to central executive committee for approval.
    iii. To select candidates for upper house from the party and forward to central executive committee for approval.
    iv. In recommendation with district executive committee, Select the candidates for district Chairman, vice-Chairman in local elections.
    v. To make a working constitution and send it to the central executive committee for approval and conduct activities according to it once it gets approved.
       
33. Parliamentary party
  Consisting of the elected parliament members and upper house members, a parliamentary committee will be formed. One of the parliament members will be elected as a parliamentary leader by the committee members. This will form a working constitution and follow it after having it approved by the central executive committee.
       
34. Central Working Committee:-
 

In the chairmanship of party chairman 7 member central working committee will be formed. There will be a general secretary and 5 central executive committee members nominated from among the committee members.

  The following will be its job and duties;
  a. To carryout the immediate works of central executive committee during the intervening period of the two meeting.
  b. To follow and implement central committee decisions and monitor the implementation.
  c. To do all the tasks passed on to by the central committee.
  d. To table all kinds of works such as job accomplishments, decisions and important issues, into the central executive committee meeting that follows.
     
35. Disciplinary Committee:
  a. Under the convenorship of a central committee member, the central executive committee will form a five members disciplinary committee. Rest of the other members will be selected out of general convention representation.
  b. This committee will monitor disciplinary code of action of all member and will prepare the report for action. But except for the district executive committee officials and members as regards the necessary investigation on the indiscipline and code of conduct of local level cadres this committee can delegate its power to district executive committee, district disciplinary committee or any person.
     
36. Judiciary Committee:
  Including a central member appointed by the central executive committee, a 3 member Judiciary committee will be formed. The rest two members will be selected out of the general convention representatives. The job, duties and authority of this committee will be as following.
  a. To present written opinion to the central executive committee when asked on the difficult question regarding the interpretation of the party constitution.
  b. To submit its opinion on the question of constitutional and legal matters related to the party, to the central committee.
  c. To produce written opinion on the subject of discipline and election to the central committee or any other central level commissions and sub committees if needed.
  d. To do other judicial works directed by the central committee.
     
37. Advisor:
  a. Different level executive committees can nominate their advisors for the sake of convenience in party functioning but not beyond and above the number in related executive committee members.
  b. These Advisors can be invited in need of executive and related council meetings.
     
38. Central Secretariat:
 

There will be a central secretarial under the convenorship of the general secretary to effectively carry out the functions, decisions, programmes and policies of the central executive committee.

    The following will be it's functions and responsibility.
  a. To prepare party policies, programmes and action plan at the central level.
  b. To develop strategies for the effective implementation of the programmes to be conducted by the central committee and party organization under it.
  c. To coordinate and conduct the functions of various department of central committee effectively.
  d. If party views on contemporary issues are to be made public, this secretariat will do so.
  e. To establish harmony among the party organizations in co-ordination with central committee.
  f. To carryout the responsibilities assigned by the central committee and central council.
     
39. Meeting Management:
  a. Central executive committee meeting will be held at least once in three months but other level executive meetings will be held once in a month.
  b. All level council meetings will be held at least once in a year but it will not meet in the year of general convention.
  c. General convention will be held once in four years.
  d. Every level executive committees and councils will have to send the meeting reports to their seniors levels, i.e. decisions and the information of the programmees held in the committees.
  e. The general secretary or secretary will have to call the meeting with the order of the Chairman in condition of written demand made by one third members of councils, committees or central convention.
  f. Every level of committee, council or convention meeting will be chaired by the relevant chairman.
     
40. Post Expiry Vacancy and Fulfillment:
  a. If any member is promoted to upper level by election or nomination, the current post will fall vacant but if the person elected to central council member or convention representative from a regional level is elected or nominated to district executive committee, the current post will remain intact.
  b. Officials at any level who remain absent in three consecutive meeting the concerned executive committee can decide to terminate the post of such a member. But such a member will not be deprived the opportunity of clearification.
  c. If any elected post remains vacant, it will be fulfilled by the decisions of concerned level executive committee for the remaining period.
     
41. Election Committee and Election Procedure:
  a. Election committee will be formed in order to organize party systematically at different levels.
  b. The duties, functions and power of election committee will be as specified by the central executive committee.
  c. If more than 50 % lower level committee units are formed in election, then higher level committee units can be formed. But this won't be implemented in the village executive committee elections. Election procedure will be as specified by the central election committee.
  d. Election at all levels will be done through the related councils, but the election of central executive committee will be made through the central convention.
     
42. Others:
  a. As regards nomination priority will be given to backwards aborigines, nationalities.
  b. Elected through district development act, municipality act and village development committee act, party representatives, district Chairman, district vice Chairman, municipality Mayor or vice chairman, V.D.C. chairman and vice chairman will be the members of relevant level executive committee.
  c. At all levels committee member election only the party parliamentary members and elected or nominated representatives of council or convention can participate.
  d. 5% of the women representation is compulsory at all level of executive committee.
  e. The decisions of every councils, conventions and executive committees will have to be verified by the chairman of the respective level.
     
43. Fund:
  There will be separate funds of the party at different levels. The following will be the its funds. Types of fund
  i. Membership
  ii. Contribution
  iii. Proceeds and revenues from organizing activities
  iv. Donations from organization, association and individuals without negatively affecting party objectives.
  a. Local fund
  b. The collected fund should be deposited in the bank account but this system in not compulsory in village and regional level. The fund will be mobilized only by the treasure and executive committee appointed member or official.
  c. Party account will be maintained according to the current accounting system and the account will be audited and the report will be presented in the related executive committee.
  d. Party property, either stationary or mobile will be accounted in the manner of a cash account system.
     
44. Coordinated Organizations (Class and Occupational Organization)
  a. Party will consider them as sister organizations, which favor RPP principles.
  b. There will be only one authorized organization in a class and occupational sector. Such authorized organizations will have to obey party instructions and follow it's principles.
  c. Party related class; occupational or sister organizations will be defined by the central executive committee. And their legitimacy also will be certified by this committee.
  d. The organizations that work against party spirit, disobey party central committee instructions and are inactive, can be dissolved by the party central executive committee and can be replaced with adhoc committees.
  e. Such an adhoc committee will have to have it's conventions and form an executive committee.
     
45. Capability of framing rules and regulations:
  The central executive committee can formulate, implement necessary rules within the periphery of the constitution.
   
46. Resolve impediments and Override obstructions:
  With regard to the implementation of this constitution and any obstruction arising out of such implementation, the central executive committee can take decisions to override such obstructions.
   
47. Meeting Forum:
  Central convention, central council and other level council meeting corum will be one third of the total members. But the forum of executive committee meeting will be 51% of the total members.
   
48. Delegation of power:
  Constitutionally mentioned power can be delegated to other officials of associate committees and sub committees by the authorized officials.
   
49. Framing and amendment of the constitution:
  Central convention can amend and implement the constitution having it passed by the simple majority.
   
50. Tenure:
  According to the constitution all level committee and council members will be elected or nominated for the period of four years. In special circumstances like the failure of party conventions the central executive committee can extend its period for one additional year and this is applicable to the junior levels as well.
   
51. Tabling no confidence motions:
  a. A no-confidence motion can be brought against all members and officials of all levels of executive committees up to the district level if found to be failing in discharge of duties consistent with the responsibilities and damaging the party interest and welfare. The vote of no-confidence can be registered with the relevant executive committee by one-third of the total member of the councils. The vote of no-confidence thus registered will be presented before a higher level committee which will set a date for the concerned council meeting. The person under the motion will be relieved of the post if the council meeting decide in favour of the motion by two-third majority.
  b. A no-confidence motion can be registered at the office of the central committee if the proposal is signed by one-third member of the central convention. After the registration of such proposal would be discussed at central committee after 15 days and the decision to put the matter before central convention will also be made for which a date to call for special session of the convention will be set. The concerned member would be relieved of his post if the motion is adopted in favour by two-third majority of the central convention.
  c. The no-confidence motion cannot be tabled (tabulated) until the completion of 1 year after the election and if the motion fails if cannot be revived until the completion of next 1 year.
  d. If the vote of no confidence is against the chairman himself the meeting will be chaired by one of the central committee appointed members or official. But in case of other committees the absence of chairman will be fulfilled by the vice chairman only.
     
52. Remedial Measure:
  The members of central convention, central council or junior level executive committees and councils formed before the implementation of amended constitution will be considered as formed according to this constitution.
     
  xvii. As per the political and physical needs required for the political mobilization, the district executive committee can form a "party area co-ordination committee" with members at the moot in areas stipulated for the formation of District Development Committee.
